Can states and local governments be liable under Superfund?

Yes. The Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA, commonly referred to as Superfund) liability scheme includes states and local governments. However, depending on the state and local government activity, there may be exemptions, defenses, and liability protections available.
